CENTRAL PLANNING AND MONITORING UNIT (CPMU)

   SERVICES RENDERED BY THE CPMU

The Central Planning and Monitoring Unit provides the following two key services to the
public:
a) Investigation of trade disputes
b) Analysis of Collective Bargaining Agreements (CBAs) for registration by the
Employment and Labour Relations Court (ELRC)

   PROCEDURE FOR SEEKING SERVICES FROM CPMU

a) Investigation of trade disputes

  •  Receipt of a letter and pleadings from the Registrar/Judge of the
    Employment and Labour Relations Court to investigate a trade dispute;
  • Preparation of a questionnaire to facilitate collection of information about
    the issues in dispute within 3 days;
  • Administer the questionnaire to the parties in dispute and agree on the
    collected information with each party within 14 days;
  • Preparation of an investigation report within 7 days and forward it to the
    Judge of the ELRC and to the parties in dispute prior to the hearing date of
    the trade dispute;
  • Represent the Ministry in Court during the hearing of the dispute.

b) Analysis of Collective Bargaining Agreements (CBAs) for registration by
the Employment and Labour Relations Court (ELRC)

  •  Receipt of three copies of signed CBA and schedule forms from the
    Union/Employer or their representatives at the CBA Registry;
  •  Analysis of the signed CBA for conformity to wages statutory requirements
    within 3 days;
  • Preparation of an analysis report and forwarding it together with the signed
    CBA and schedule forms to the Employment and Labour Relations Court
    for registration within 3 days;
  • Represent the Ministry in Court during registration of the CBA.

c) Provision of information on Negotiated Terms and Conditions of Service
for Economic Survey preparation

  • Receipt of a letter from the Kenya National Bureau of Statistics (KNBS) on
    submission of updated annual negotiated wages figures from the registered
    CBAs;
  • Extraction of data on terms and conditions of service between employers
    and trade unions from all the CBAs registered during the previous calendar
    year within 21 days;
  • Computation of the required figures, compilation of a report and submission
    of the same to KNBS within 14 days.
